The merchant is obligated to ensure that his products comply with applicable municipal, health and commercial laws, regulations and requirements, especially with regard to food products and perishable materials. The merchant bears full responsibility for any direct or indirect damage that may arise due to the product, its method of manufacture, storage, preparation, packaging, components, expiration date, or warnings. Liability includes any claims by users related to allergy, poisoning, spoilage, non-conformity to description, or any health/physical/financial damages resulting from the product or service. Zad Mjan is not considered a manufacturer, supplier, or guarantor of products, but rather an intermediary platform for organizing orders and facilitating communication and delivery according to operational mechanisms. The merchant is obligated to compensate Zad Mjan (when necessary and within the limits of the law) for any claims, fines, losses, or legal fees that arise due to the violation of the merchant, its products, or its behavior. The Merchant acknowledges that any licenses required for his business are his sole responsibility, including health permits, municipal licenses, commercial registry, and any additional approvals. The merchant is obligated to provide an official contact point within his store to handle reports and complaints and cooperate with technical support when requesting information regarding orders or products. Zad Mjan has the right to stop displaying products or disable a store upon suspicion of a violation or danger to users until verification, without any obligation to compensate the merchant’s losses. This clause does not prejudice any rights granted by law to the consumer, but rather regulates the distribution of responsibilities between the platform and the merchant in a clear and strict manner.
The merchant is committed to displaying his products on the platform in a professional and accurate manner, with real pictures that represent the final product as much as possible, and with clear, non-misleading descriptions. It is prohibited to use images that do not represent the real product or “misleading” general images that lead to unrealistic expectations for the user, and this is considered a serious violation that affects the reputation of the platform. Food product descriptions should include, where appropriate, basic information such as main ingredients, warnings (e.g. nuts/gluten/dairy), and serving size or approximate weight. The merchant is obligated not to place misleading titles or marketing exaggerations that contradict the truth, and not to hide additional fees within the description or notes. The merchant is obligated to avoid any offensive, infringing or violating intellectual property content (logos, trademarks, protected images) within the product, description or images. The categories and options (additions/sizes) must be neat and clear without distraction or unjustified repetition, and Zad Mjan has the right to request reorganization of the display to improve the user experience. The merchant is obligated to keep only available products “activated”, disable unavailable products, and update inventory to prevent accepting unfulfillable orders. Any recurring shortages or cancellations due to unavailability may result in reduced store visibility or temporary suspension as per performance records. Zad Mjan has the right to remove any product, image or description without prior notice if it violates the standards or is suspected to be misleading or risky. The merchant bears full responsibility for any complaints resulting from the difference between the actual product and what is displayed within the platform.
The merchant is obligated to enter correct and accurate prices for each product, option and add-on within the platform, while clearly including any price differences (volume/weight/add-on). The merchant assumes full responsibility for any error in entering the price, discount, promotion, or add-on calculation, including any losses resulting from poor data entry. If an order is executed at the wrong price due to the merchant's input, the case is handled in accordance with the laws and in a way that guarantees the user's rights without holding the platform responsible for the merchant's error. The merchant is obligated not to attempt to modify the price after accepting the order outside the system or to impose additional amounts on the user or courier without clear and registered approval. It is prohibited to hide fees within “Notes” or to charge the user with fees that are not visible before confirmation. This is considered a violation that requires measures that may lead to disrupting the store. The merchant is obligated to update prices as soon as they change within the physical store to ensure conformity and prevent disputes and complaints. In the case of products with variable prices (e.g. weight/market price), the pricing mechanism must be made clear to the user in advance within the product description in a manner that is not misleading. Offers and discounts must be real, and it is prohibited to artificially raise the price before the discount to mislead, and this is subject to internal evaluation and consumer rights. Any recurring pattern of pricing errors or complaints may result in the store being restricted or temporarily suspended to protect users. Zad Mjan does not bear any responsibility for the merchant’s losses resulting from his pricing errors or mismanagement of his offers within the platform.
The merchant is obligated to follow health and food safety standards in preparing, storing and preparing meals and perishable products, in accordance with applicable regulations. Packaging must be done in a safe way that prevents leakage, spillage or contamination of food, and using suitable containers that can withstand transportation and heat/cold depending on the nature of the product. The Merchant is obligated to clearly label/distinguish where necessary (e.g. “hot”, “breakable”, “keep refrigerated”) to facilitate handling by the courier and reduce risks. The Merchant is obligated to ensure that the order is complete and identical (meals/additions/drinks/tools) before handing it over to the courier or the user in self-collection. It is prohibited to deliver expired products or whose safety is questionable. This is considered a serious violation that requires immediate action that may lead to permanent suspension. In the event of a common food allergy, the merchant is obligated to place clear warnings within the description when possible to reduce the risks. The merchant is responsible for any health or physical damage resulting from improper preparation, storage, packaging, or providing incomplete information about the ingredients. The Merchant is obligated to cooperate with support to provide clarifications when there is a safety or quality complaint, and may request the provision of operational manuals as the case may be. Zad Mjan has the right - to protect users - to suspend a food product/section when a health risk is suspected until verification is completed. Zad Mjan is not considered a health regulatory body, and the responsibility for complying with health requirements falls entirely on the merchant alone.
If self-pickup service is available, the merchant is obligated to organize the in-store pickup process in a respectful and safe manner that does not cause crowding, chaos, or violate the user’s privacy. The merchant is obligated to deliver the order to the correct user only, and this may require verifying the order number or any verification method within the system to avoid wrong delivery. The merchant is prohibited from using self-pickup as a means of imposing undisclosed additional fees or forcing the user to purchase other products. The merchant is obligated to specify a realistic readiness time for the order, and not to announce “ready” before processing is complete, to avoid complaints of delay or loss of confidence. The Merchant is committed to professional communication with the User, and refrains from abusing, threatening, blackmailing or forcing the User to give a positive rating. It is prohibited to communicate outside the platform to request sensitive information or to conduct transactions outside the system, and this is considered a serious violation. The merchant is obligated to handle errors flexibly within the limits of the law and its internal policies, and at a minimum, respect the rights of the user and the rights of the consumer. In the event of a dispute occurring within the store, the merchant is obligated to act in an orderly manner and not to harm the user, and Zad Mjan has the right to take action on the account if a violation is proven. self-pickup does not eliminate the merchant's responsibility for quality, conformity, or safety, and complaints remain in accordance with the system. Zad Mjan is not responsible for any direct dealings outside the platform or inside the store, and the responsibility for conduct and procedures lies entirely with the merchant.
The merchant is committed to dealing professionally with the couriers, respecting their time and operational role, and not disrupting the receipt, insulting the courier, or holding him responsible for the merchant’s errors. The merchant is obligated to prepare the order within the expected time, and to have the order actually “ready” when the courier arrives as much as possible to reduce delay. The order must be delivered to the courier tightly packaged, making sure that the items are complete, because any shortage after delivery causes disputes and harms the platform’s reputation. The merchant is prohibited from delivering non-conforming or incomplete products to the courier while trying to hold the courier responsible for that later. The merchant is obligated not to ask the courier for additional fees or impose conditions outside the system, and any comments must be through the system and documented. In the event of a problem (unavailable/alternative product/delay) the merchant must update the status within the system and communicate through official channels. The merchant is prohibited from using the courier for tasks outside the order or forcing him to wait unjustifiably without a clear operational reason. Zad Mjan has the right to monitor indicators of delayed pickup from the store, and may take measures such as reducing store visibility or temporary suspension when delays occur again. The Merchant is committed to maintaining an organized receiving area within the store to reduce clutter and ensure fast and safe delivery. Any repeated abuse of couriers or unprofessional behavior may lead to the store being suspended or shut down to protect the operation of the platform.
The merchant is obligated not to offer or sell any prohibited or legally restricted products unless he is licensed and authorized to do so and in accordance with the laws and regulations. It is the merchant's responsibility to check age or regulatory restrictions on specific products, if any, and to deliver them only as permitted by law. The sale of counterfeit products or products that infringe intellectual property rights or trademarks is prohibited and is grounds for immediate suspension and action. Merchant adheres to requirements to display basic product data when legally mandatory (e.g. source/validity/ingredients/warnings) by type of business. The merchant is obligated to provide invoices or sales records when required according to the tax/commercial regulations within the scope of operation. Zad Mjan has the right to request compliance documents from the merchant (such as commercial registry/municipal license/health permit) when needed, and failure to provide them may result in the store being suspended. Zad Mjan has the right to remove any product suspected of violating the law even before the investigation is completed to protect users and the reputation of the platform. Zad Mjan is not responsible for any fines or legal procedures imposed on the merchant as a result of violating the regulations or selling violating products. The merchant is obligated to cooperate with the competent authorities when there is a legal request, within the limits of the law, and in a manner that does not violate the privacy of users. This clause is considered an essential basis for the continuation of the merchant’s partnership with the platform, and any violation of it exposes the account to immediate suspension.
Zad Mjan may provide the merchant with internal marketing tools such as store exposure, special offers, coupons, or arranging appearances within certain departments according to operational terms. The merchant is obligated to ensure that the offers are real and clear, and do not include misleading, hidden conditions, or price “bait” that leads to deceiving the user. The duration and limits of the offer (number of lots/days/minimum) must be as clear to the user within the platform as possible. If the merchant fails to fulfill orders during shows due to stock shortages or poor planning, he shall bear responsibility for complaints and operational consequences. Zad Mjan has the right to stop any promotion if it causes abnormal pressure, widespread complaints, high cancellation pattern or fraud indicators. The merchant is prohibited from using the platform to send direct marketing messages to the user outside the system or collect his data for marketing without explicit consent. The platform may provide analytics on campaign performance (views/orders) to assist the merchant, but the decision on implementation and quality of products remains the responsibility of the merchant. Any advertising materials provided by the merchant (images/texts) must be free of legal or rights violations or offensive content. The platform remains the right to organize the display mechanisms in a way that achieves the user’s interest and the quality of the experience, without any obligation to compensate for changes in the display order. Zad Mjan does not guarantee specific marketing results, but it does provide tools and criteria to improve visibility based on merchant performance, ratings, and commitment.
Zad Mjan provides the merchant with a control panel that includes tools to manage products, orders and offers, and may include operational reports such as daily/weekly/monthly/yearly when available. Reports include, subject to availability, data such as number of orders, sales, average preparation time, cancellations, most requested products, and performance indicators. Merchant acknowledges that these reports are displayed for assistance and decision-making purposes, and may be based on operational data that is subject to change based on system updates and order status. The Merchant is obligated not to misuse reporting data to manipulate, defraud, or unlawfully target users. Zad Mjan may provide modern tools to display products in an organized manner (categories, options, images, additions) to facilitate the user experience and reduce distraction. The merchant is obligated to follow the platform's display guidelines (e.g. image sizes, description style) to ensure a professional appearance and overall consistency. The feature of requesting reports may be provided when needed within the trader's panel, and Zad Mjan has the right to impose limits on heavy orders to protect overall performance. Zad Mjan reserves the right to modify the form of reports, develop them, or discontinue some of them in accordance with technical updates, without obligation to compensate. Merchant data and orders remain protected within the Privacy Policy, and the platform applies reasonable security measures to protect operational data. The trader remains responsible for making his own trading decisions based on the reports and the platform does not bear responsibility for decisions or losses resulting from misinterpretation of the data.
Zad Mjan may provide mechanisms to settle the merchant’s financial dues (periodic transfers/settlements) according to an operational financial policy that is applied according to the type of payment and the collection mechanism. Settlement may include deduction of an agreed upon commission/service fee, or any operational fees declared to the merchant within the joining agreement or control panel. The merchant is obligated to provide correct financial data (such as bank account/wallet/legal name) and any error therein shall be borne by the merchant for the consequences and delay in the transfer. Transfers are subject to processing times of banks or payment providers, and may be delayed for reasons beyond the control of the platform such as public holidays or financial verification procedures. In the event of a financial dispute, “incomplete” orders, or return claims, part of the settlement may be suspended until the dispute is verified and resolved according to the procedures. The merchant is obligated to maintain his internal accounting records, and Zad Mjan is not responsible for his tax obligations, billing requirements, or any regulatory obligations related to him. Any attempt to tamper with orders, cancel them after delivery, or falsify records with the aim of increasing dues is prohibited, and is considered a serious violation that may lead to suspension and legal action. Zad Mjan has the right to apply financial security limits to withdrawals/settlements to protect the system from fraud or operational errors. If there is a “minimum transfer” policy or “transfer schedule” it is made clear to the merchant within the dashboard or agreement. Zad Mjan is not responsible for the merchant's losses resulting from mismanagement of funds, his financial decisions, disputes caused by his products or operational errors.
Zad Mjan is committed to implementing reasonable security measures to protect merchant data within the platform, such as securing sessions, controlling permissions, and recording activities when needed. The platform provides the merchant with tools to manage their products and orders in a modern way, and update prices, availability and offers in an organized manner to reduce errors and improve the user experience. The Merchant acknowledges that protecting login data is a shared responsibility, and the Merchant must use a strong password and not share or store it insecurely. The merchant is obligated not to grant panel powers to any unauthorized person, and not to use shared accounts in a way that causes conflict or difficulty tracking. The platform may provide security alerts and notifications when abnormal behavior is detected, and the merchant must act quickly and report any suspicion. The Merchant acknowledges that any data leakage due to internal negligence (such as password sharing) is his responsibility, and Zad Mjan will not bear the consequences thereof. The Platform may undertake maintenance or technical updates that temporarily affect access to the Panel, and works to minimize the impact as much as possible. Zad Mjan has the right to temporarily suspend access upon suspicion of a breach to protect the data of the merchant and other parties, until verification is completed. Zad Mjan is committed not to share merchant data with parties that are not necessary to operate the service, and the privacy policy applies to that. Zad Mjan does not guarantee 100% absolute protection, but it adheres to reasonable operational standards according to capabilities and needs, and the merchant must take additional precautions internally.
The Merchant acknowledges that any damage resulting from its products, services, conduct or operational errors (pricing/packaging/preparation/delay/violation) is entirely within its legal responsibility. Zad Mjan is not responsible for any claims regarding the product’s quality, safety, conformity to the description, suitability, health effects, or potential damage. Zad Mjan is not responsible for any disputes resulting from direct dealings between the merchant and the user outside the platform or inside the store, including self-pickup. Zad Mjan is not responsible for any financial losses incurred by the merchant due to his errors in pricing, display, inventory management, or planning offers. The merchant is obligated to protect the platform from any reputational damage or legal claims due to the merchant’s violation, and the platform may ask him to cooperate to provide information when needed. Zad Mjan has the right to take operational measures to protect users, such as temporarily suspending or immediately deleting a product/store when risks are suspected. This clause does not prejudice the rights of the consumer according to the law, but it strictly explains the distribution of responsibility between the platform (technical intermediary) and the merchant (actual provider). If a competent authority requests data about the merchant’s products or activity, Zad Mjan may cooperate within the legal procedures and to the minimum required. The merchant's continued use of the platform means that he accepts this explicit responsibility and acknowledges that he is the decision maker regarding what he offers and sells. Any attempt to hold the platform responsible for obvious damages caused by the merchant may be rejected with the application of appropriate procedures according to records and agreements.
